ARTICLE 1 - OBJECT
These conditions govern sales by the company SASU Hardie whose registered office is located at 1 ter la tuilerie, 27830 Neaufles saint Martin and offering sales services of decorative objects/art.
ARTICLE 2 - PRICE
The prices of our products are indicated in euros all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise stated and excluding processing and shipping costs.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of SASU Hardie.
They will be at your expense and are your full responsibility, both in terms of declarations and payments to the competent authorities and bodies of your country. We advise you to inquire about these aspects with your local authorities.
All orders regardless of their origin are payable in euros.
Hardie Studio reserves the right to change its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of validation of the order and subject to availability.
The products remain the property of Hardie Studio until full payment of the price.

The contractual information is presented in French and will be confirmed no later than the validation of your order.
SASU Hardie reserves the right not to register a payment, and not to confirm an order for any reason, and more particularly in the event of a supply problem, or in the event of difficulties with the order received.
ARTICLE 4 - VALIDATION OF YOUR ORDER
Any order appearing on the website www.hardiestudio.com presupposes adherence to these Terms of Sale. Any order confirmation entails your full and complete adherence to these general conditions of sale, without exception or reservation.
All the data provided and the recorded confirmation will be proof of the transaction.
You declare that you have perfect knowledge of it.
The order confirmation will be the signature and acceptance of the operations carried out.
A summary of your order information and these General Conditions will be communicated to you in PDF format via the e-mail address to confirm your order.
ARTICLE 5 – PAYMENT
Validating your order implies for you the obligation to pay the indicated price.
Payment for your purchases is made by credit card thanks to our secure payment systems.
The card is only charged at the time of shipment of the order. In the case of split deliveries, only the products shipped are debited.
We offer the following payment systems:
Stripe (Visa, Mastercard, etc), Paypal.
ARTICLE 6 - WITHDRAWAL AND RETURNS
In accordance with the provisions of Article L 221-5 of the Consumer Code, the Buyer has a period of fourteen (14) days from the date of delivery of his order, to return any item that does not suit him and request a refund without penalty, with the exception of the return costs which remain the responsibility of the buyer.
Returns are to be made in their original and complete condition (packaging with protection...) allowing them to be remarketed in their original state, accompanied by the purchase invoice.
Damaged or soiled works are not taken back.
The right of withdrawal can be exercised by contacting the seller by email: hardiestudio@gmail.com.
The refund will be made no later than 14 days from the receipt by the seller of the products returned by the buyer under the conditions provided for above.
For any order of a work made to order, specifically by the artist at the request of the customer, it may not be cancelled or refunded. Indeed, the right of withdrawal cannot be applied, in accordance with the provisions of Article L 121-20 of the Consumer Code as amended by Ordinance No. 2001-741 of August 23, 2001 which stipulates that the withdrawal period is fifteen (15) days, and withdrawal is excluded in particular (Article 121-20.2 3rd paragraph) for contracts for the supply of goods clearly personalized or made according to the consumer's specifications, in particular for custom-made items.
The creations are all made to order, the right of withdrawal is therefore not applicable for the latter. It is applicable for posters and posters only.
ARTICLE 7- AVAILABILITY
Our products are offered as long as they are visible on the website www.hardiestudio.com and within the limits of available stocks. For unstocked products, our offers are valid for pre-order. In case of product unavailability after placing your order, we will inform you by email. Your order will be automatically canceled and no bank debit will be made.
In addition, the website www.hardiestudio.com is not intended to sell its products in large quantities. Therefore, the company Hardie Studio reserves the right to refuse orders for 15 identical items.
ARTICLE 8 – DELIVERY
The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page.
In case of shipping delay, an email will be sent to you to inform you of a possible consequence on the delivery time indicated to you.
In accordance with the legal provisions, in the event of a delay in delivery, you have the possibility to cancel the order under the conditions and procedures defined in Article L 138-2 of the Consumer Code.
If in the meantime you receive the product, we will refund it and the shipping costs under the conditions of Article L 138-3 of the Consumer Code.
In the case of deliveries by a carrier, Hardie Studio cannot be held responsible for delay in delivery due exclusively to the customer's unavailability after several appointment proposals.
ARTICLE 9 – GUARANTEE
All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for in Articles 1641 et seq. of the Civil Code. In the event of non-compliance of a product sold, it may be returned, exchanged or refunded.
All complaints, exchange or refund requests must be made by email within 30 days of delivery.
The products must be returned to us in the state in which you received them with all the elements (accessories, packaging, instructions...). Shipping costs will be refunded to you on the basis of the invoiced rate and the return costs will be refunded to you upon presentation of supporting documents.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
ARTICLE 10 – RESPONSIBILITY
The products offered comply with the French legislation in force. Hardie Studio cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you plan to order.
In addition, Hardie Studio cannot be held responsible for damage resulting from misuse of the purchased product.
Finally, Hardie Studio cannot be held responsible for any inconvenience or damage inherent in the use of the Internet, including a service break, an external intrusion or the presence of computer viruses.
ARTICLE 11 - LAW APPLICABLE IN THE EVENT OF A DISPUTE
The language of this contract is French. These conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.
ARTICLE 12 - INTELLECTUAL PROPERTY
All elements of the site www.hardiestudio.com are and remain the intellectual and exclusive property of Hardie Studio.
No one is authorized to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple or hypertext link is strictly prohibited without the express written consent of the company Hardie Studio.
ARTICLE 13 - PERSONAL DATA
Hardie Studio reserves the right to collect personal information and personal data about you. They are necessary to manage your order, as well as to improve the services and information we send you.

ARTICLE 14 - ARCHIVING / EVIDENCE
Hardie Studio will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
